Terms And Conditions
Trelawney Glass Limited
1. Definitions
1.1 “Company” refers to Trelawney Glass Limited.
1.2 “Client” refers to any individual, firm, or company purchasing goods or services from the Company.
1.3 “Goods” means all products, including but not limited to glass, sealed units, heritage units, and balustrade systems supplied by the Company.
1.4 “Works” means all installation, repair, or related services carried out by the Company.
2. Quotations and Orders
2.1 All quotations are valid for 30 days unless otherwise stated.
2.2 An order shall only be deemed accepted once confirmed in writing by the Company or by the Client instructing the Company to proceed with the Works.
2.3 The Company reserves the right to amend or withdraw any quotation prior to acceptance.
2.4 Any variations or additional works requested by the Client must be agreed in writing and may incur additional charges.
3. Pricing and Payment
3.1 Trelawney Glass is not VAT Registered, all Prices are total payable, unless otherwise stated.
3.2 Full payment is due within 10 days of completion of the Works unless otherwise agreed in writing.
3.3 The Company reserves the right to request deposits or staged payments where appropriate.
3.4 The Company reserves the right to charge statutory interest and recovery costs on late payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
3.5 The Company reserves the right to suspend further Works or deliveries until outstanding payments are settled.
4. Retention of Title
4.1 All Goods supplied shall remain the property of Trelawney Glass Limited until full payment of the invoice has been received in cleared funds.
4.2 Until ownership passes, the Client shall hold the Goods as bailee for the Company and shall keep them in good condition and identifiable as the Company’s property.
4.3 The Company reserves the right to recover Goods where payment has not been made.
5. Guarantees
5.1 The Company provides the following guarantees from the date of installation:
Sealed Units: 5 years
Heritage Units: 2 years
Decra-Lead Adhesive: 10 years
Window Films : 7 Years
5.2 Guarantees apply to defects in materials or workmanship only and do not cover:
Damage caused by misuse, negligence, or accidental damage
Normal wear and tear
Failure caused by external factors beyond the Company’s control
Breakage or damage occurring after installation unless directly attributable to faulty workmanship
5.3 Glass products may contain minor imperfections, distortions, or tolerances consistent with industry standards and these shall not be considered defects.
5.4 Trelawney Glass Limited provides the following guarantees on door and window hardware from the date of installation:
Door Gearboxes – 2 Years
Window Gearboxes – 2 Years
Hinges – 2 Years
Handles – 2 Years
Window and Door Espagnolette Mechanisms – 2 Years
Key Barrels / Cylinders – 5 Years
These guarantees apply to defects in materials and workmanship only and do not cover damage caused by misuse, accidental damage, forced entry, lack of maintenance, fair wear and tear, or external factors beyond the Company’s control.
All moving parts, including hinges, locking mechanisms, espagnolette systems, gearboxes, and cylinders, require periodic lubrication and maintenance by the Client using a suitable light lubricant.
Failure to adequately maintain and lubricate moving components at reasonable intervals will invalidate all applicable guarantees.
6. Inspection and Acceptance
6.1 The Client is responsible for carrying out a full site inspection of the Works prior to the Company’s operatives leaving site.
6.2 Any defects in materials or unsatisfactory workmanship must be reported as soon as reasonably practicable and in any event within 24 hours of installation.
6.3 Any damage to property must be reported within 24 hours of the Company leaving site.
6.4 Failure to report within this timeframe may invalidate any claim.
7. Client Responsibilities
7.1 The Client is responsible for obtaining all necessary permissions prior to commencement of Works, including but not limited to:
Church authorities
Heritage bodies (including Historic England or equivalent)
7.2 The Client shall be liable for any fines, penalties, or enforcement action resulting from failure to obtain such permissions.
7.3 The Client must ensure safe and adequate access to the site for the Company’s operatives.
7.4 Any delays caused by lack of access, unsafe conditions, or other trades may result in additional charges.
7.5 Any advice or guidance provided by the Company is given in good faith and for general guidance only. The Client must seek confirmation from relevant authorities before proceeding with any Works.
8. Access, Delays and Additional Costs
8.1 The Company reserves the right to charge for aborted visits where access is not available or the site is not ready.
8.2 Additional costs may be incurred where specialist access equipment, scaffolding, or lifting equipment is required and not previously agreed.
8.3 The Company shall not be liable for delays caused by weather conditions, site conditions, or third parties.
9. Consumer Rights
9.1 Where the Client is a consumer, the Company will comply with the Consumer Rights Act 2015.
9.2 The Company will carry out Works with reasonable care and skill and supply Goods that are of satisfactory quality and fit for purpose.
10. Cancellation Rights
10.1 Where applicable, the Client may have the right to cancel under the Consumer Contracts Regulations 2013.
10.2 Where the Client requests Works to commence within the cancellation period, the Company reserves the right to charge for any work carried out and materials supplied up to the point of cancellation.
11. Limitation of Liability
11.1 The Company shall not be liable for any indirect, consequential, or economic loss, including loss of profit, business, or opportunity.
11.2 The Company’s total liability shall not exceed the total value of the contract.
11.3 Nothing in these Terms shall limit liability for death or personal injury caused by negligence or for fraud.
12. Insurance
12.1 The Company maintains appropriate public liability insurance. Details are available upon request.
13. Marketing and Photography
13.1 The Company reserves the right to take photographs of completed Works.
13.2 Such images may be used for advertising, promotional, or marketing purposes without further consent or compensation.
14. Force Majeure
14.1 The Company shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, adverse weather, supply chain disruption, or labour shortages.
15. Data Protection
15.1 The Company will process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.
16. Governing Law
16.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
16.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Amendments
17.1 The Company reserves the right to amend these Terms and Conditions at any time without prior notice.
